Advisors' Opinion:
  • [By Alan Brochstein]

Taking into account all of the data I have shared, I want to introduce my take on the most important names to follow. My initial list takes into account not only the market cap, but also business model and interest level. These are the stocks that I think merit the most attention (in alphabetical order):

    CannaVest (CANV.OB)GW Pharma (GWPH)MedBox (MDBX.PK)Medical Marijuana, Inc. (MJNA.PK)

CANV doesn't really trade, as it is held closely by insiders (99.7%, including MJNA). I have a few concerns, including the valuation and some near-term financial challenges typical of a start-up with just one client looking to expand its customer base, but I like the focus and the fact that it is an SEC filer with a relatively clean history (i.e. none of the baggage of some of these other companies). I have spoken to its outsourced CFO and am impressed by his background (has been CFO or held key financial roles at publicly-traded healthcare companies). CANV is the partner to MJNA that is responsible for manufacturing the CBD (Cannibidiol, the cannabinoid in marijuana that is increasingly viewed as offering substantial medical benefits). I am very concerned about the near-term financials, but this is a pure-play with probably a two-year lead over other companies. I don't see a moat in terms of intellectual property or brands, but they have a good lead in terms of sourcing of supply and penetration into potential customers. Quite simply, they don't appear to have competition at present. The company, then, is a call option on CBD demand taking off. It appears that it could be a supplier to even Big Pharma should medical marijuana research move into the mainstream.

Advisors' Opinion:
  • [By Roberto Pedone]

Intevac (IVAC) provides process manufacturing equipment solutions to the hard disk drive industry and high-productivity process manufacturing equipment and inspection solutions to the photovoltaic industry. This stock closed up 8.5% to $6.74 in Tuesday's trading session.

    Tuesday's Range: $6.23-$6.75

    52-Week Range: $4.06-$6.80

    Tuesday's Volume: 263,000

    Three-Month Average Volume: 140,032

From a technical perspective, IVAC soared higher here right off some near-term support at $6.25 with above-average volume. This stock has been uptrending strong for the last three months, with shares moving higher from its low of $4.31 to its recent high of $6.80. During that move, shares of IVAC have been consistently making higher lows and higher highs, which is bullish technical price action. That move has now pushed shares of IVAC within range of triggering a major breakout trade. That trade will hit if IVAC manages to take out its 52-week high at $6.80 with high volume.

Traders should now look for long-biased trades in IVAC as long as it's trending above some near-term support levels at $6.25 or at $5.92 and then once it sustains a move or close above its 52-week high at $6.80 with volume that hits near or above 140,032 shares. If that breakout hits soon, then IVAC will set up to enter new 52-week-high territory, which is bullish technical price action. Some possible upside targets off that breakout are its next major overhead resistance levels at $8 to $8.37. Any high-volume move above those levels will then put $9 to $9.36 within range for shares of IVAC.

Ford Offers Fusion With Zero Dollar Finance Package

Ford Motor Co. (NYSE: F) must have a great deal of trouble selling its inventory of 2014 Fusions. It has started to offer among the most aggressive incentive packages in the industry so far this year.

Under terms of new leases for the Fusion, Ford Credit Financing has a 0% APR for 60 months in some regions of the United States. “Cash back” for the Fusion ranges from $1,000 to $2,500.

Lease offers for the 2014 Fusion SE are just as attractive — $0 down payment, $0 first month payment and $0 cash at signing.

The Fusion deals are another in a line of incentives given by manufacturers to move cars that have not sold well, or have very large inventories, off of lots.

The Fusion was among the top 20 selling cars and light trucks in the United States during January. Ford sold 20,717 Fusions, but that was down 7.5% from the same month in 2013. The Ford brand has struggled with all the vehicles it has among the top 20 sellers, based on January data. Sales of the Focus, Explorer and Escape were all down. Even sales of Ford’s flagship F-150 dropped slightly. Overall, Ford’s sales fell 7.5% to 153,494 for the month.

News that car companies have started to aggressively discount is not new. According to the Dallas News:

With inventories of new vehicles at their highest levels since the recession, look for some big sales incentives in the weeks ahead.

"We think incentives are going to start climbing," Larry Dominique, executive vice president of TrueCar, told Automotive News.

All of the Detroit 3 began February with more than a 100-day supply of unsold vehicles – enough to last almost to Memorial Day at the selling rates in January.

Other automakers had 88 days' worth of vehicles as of Feb. 1 – the most for that date since 2009, at the peak of the recession.

For consumers, the test is not whether there are incentives anymore; in an industry awash with them, it is where buyers can best find them.

Publicly traded Craft Brew Alliance (BREW) is the owner of three key craft beer brands. The company, through two mergers, owns the brands Redhook, Widmer, and Kona. One of those brands (Redhook) has a partnership coming with Buffalo Wild Wings that could create coverage of the company's stock and blow revenue estimates out of the water.

The fantastic performance and growth of this company was noted by Portfolio Grader back in August and the stock was upgraded to an A. Shares of SAM stock remain a “strong buy” at the current price. When it comes to beer stocks to buy now, this is one of the most tempting.

PepsiCo (NYSE: PEP  ) is another company that's succeeding with viral video advertising. This time, Pepsi's "Gordon Test Drive" commercial stole the spotlight. In the video, NASCAR icon Jeff Gordon takes an unsuspecting car salesman on a wild wide. The video was part of a campaign to promote the soda and snack giant's Pepsi Max brand, and by Visible Measures calculations, the ad was quite effective. In fact, during the first week in April Pepsi's video was watched more than 2 million times online, according to Visible Measures.

It is well known than Pepsi has been winning over Coca-Cola (NYSE: KO) in blind taste tests conducted through the decades, including modern neuro-scientific tests. Yet people prefer Coke when they know what they are sipping. But there's more to PepsiCo than its cola. PepsiCo's Carbonated Soft Drinks (CSD) share is only 40% of its business now (a 10% decrease in the last decade). The company's non-carbonated drinks range from Lipton tea to Tropicana and Naked labels. It is worth noting that of late Americans are also drinking less orange juice which could be bad for PepsiCo's Tropicana label; the market's open interest in positions was recently at its lowest in 20 years.

Shares of Monster Beverage (NASDAQ: MNST) jumped 30.48% on Friday after the company and Coca-Cola Company (NYSE: KO) announced a long-term strategic partnership. As part of the deal, Coca-Cola will buy a 16.7% equity stake in Monster. Monster Beverage Corp (NASDAQ: MNST), a mid cap marketer and distributor of energy drinks and alternative beverages, has been a monster of a performer since the end of the financial crisis as the stock is up around 308% over the past five years, but could new or overlooked players like small cap beverage stocksJones Soda Co (OTCMKTS: JSDA), Celsius Holdings, Inc (OTCMKTS: CELH) and Konared Corp (OTCBB: KRED) repeat that performance? A look strictly at the long term performance of all three small caps might have you thinking otherwise. After all, none of these small cap beverage stocks are profitable whilethe beverage industry can be a long hard expensive slog just to increase market share by one or two points when you are competing for shelf space with industry giants like Pepsi and Coke. But past performance is just thatthe past and only part of the story as there is much more to consider about these small cap beverage stocks which could also make them potential acquisition targets by larger beverage players seeking to expand their product line up with innovative products:

Finally, energy-drink maker Monster Beverage (NASDAQ: MNST  ) tacked on 4.1% after being named to investment firm UBS' (NYSE: UBS  ) top picks list for the second-quarter. According to Wall St. 24/7, UBS has selected 14 top picks which are expected to return 25% from their current levels, of which Monster is one. There's little denying that Monster has exceeded the growth rate of nearly all of its peers, thanks to the strength in its energy-drink sales. However, an FDA probe into the safety of its drinks, and the potential for increased governmental regulation, is enough of a gray cloud to keep me firmly away from Monster Beverage.

Advisors' Opinion:

The firm is currently Zacks Rank # 3 - Hold, and it also has a longer-term recommendation of Underperfom. For investors looking for a Zacks Rank # 1 Strong Buy, Ignite Restaurant Group Inc. (IRG) and The Wendy's Company (WEN) could be the options.

  • [By Seth Jayson]

Margins matter. The more Ignite Restaurant Group (Nasdaq: IRG  ) keeps of each buck it earns in revenue, the more money it has to invest in growth, fund new strategic plans, or (gasp!) distribute to shareholders. Healthy margins often separate pretenders from the best stocks in the market. That's why we check up on margins at least once a quarter in this series. I'm looking for the absolute numbers, so I can compare them to current and potential competitors, and any trend that may tell me how strong Ignite Restaurant Group's competitive position could be.

Advisors' Opinion:

Yet, Europe's leading potash player K+S (NASDAQOTH: KPLUY  ) just said that, because of the upheaval that's occurred in the market, it was slashing its dividend by 82% for 2013, reducing the payout ratio to just 11% of adjusted after tax earnings, a far cry from the miner'! s usual ratio of between 40% and 50%. Could this signal a new era of austerity that will ultimately see Potash, Agrium (NYSE: AGU  ) , and Mosaic (NYSE: MOS  )  end up whacking their payouts, as well?

  • [By Rich Duprey]

Canpotex, the cartel's rival North American potash marketing association, comprised of Mosaic (NYSE: MOS  ) , PotashCorp (NYSE: POT  ) , and Agrium (NYSE: AGU  ) , is a major supplier of potash to Brazil, with some analysts estimating it owns 38% of the market. In years past, Latin America -- primarily the Brazilian market -- has comprised as much as 26% of Canpotex's potash sales.

Potash Corp of Saskatchewan (POT), for instance, lost 16% last year, while Mosaic (MOS) dropped 15%, Intrepid Potash (IPI) plunged 26% and Agrium (AGU) declined 5.9%.

Fidelity late but not too late with new ETFs

fidelity, vanguard, etfs, mutual funds, blackrock Bloomberg News

Fidelity Investments is making its first big leap into the exchange-traded fund arena Thursday with the launch of 10 sector ETFs, but the question remains: Is it too little, too late?

Several analysts are saying, "No."

"ETFs still have a long way to go before they catch up to mutual funds, and there's still room for entrants," said Mike Rawson, an analyst at Morningstar Inc. "I think we should wait a few years to see what else Fidelity is able to do."

(Featured Data: 3Q's Best- and Worst-Performing Equity ETFs)

Ten years ago, Fidelity launched its first and only ETF: the $262 million Fidelity Nasdaq Composite Tracking ETF (ONEQ). It hasn't launched another since and has largely missed out on the ETF boom.

Total assets in the ETF market have increased to $1.6 trillion this year, from $125 billion in 2003, making Fidelity's share of the market a mere sliver, according to data from BlackRock Inc., the largest ETF manager and a subadviser to Fidelity's sector ETFs.

"They haven't had a clear ETF strategy, and they haven't pursued it [as] aggressively as they should have," Mr. Rawson said. "Even though [ETFs] are small in relation to the mutual fund market, their flows are large."

5 Best Penny Stocks To Invest In 2016

TOUGH COMPETITION

Fidelity faces heavy competition. There now are more than 1,500 ETFs, up from less than 150 10 years ago. And the number of companies launching them has grown to 58, from less than 10 in 2003, according to BlackRock.

Waiting, however, may have been Fidelity's best strategy, said Jim Lowell, editor of the Fidelity Investor newsletter.

The company held off until now to ensure that ETFs didn't become commoditized too quickly and potentially unprofitable as a business, he said.

The delay also has allowed the company to enter at a time when it can be competitive on costs.

Fidelity's 10 sector ETFs will charge 12 basis points in management fees, according to a filing with the Securities and Exchange Commission.

That compares with the 14 basis points that The Vanguard Group Inc. charges on its sector ETFs, which were the cheapest available.

"This isn't a knock on the door. This is a punch in the face over at Vanguard," Mr. Lowell said.

"Fidelity can afford to commoditize sector ETFs further and faster ... There's a huge business opportunity here," he said.

State Street Global Advisors, which manages the ! largest suite of sector ETFs, charges 18 basis points.

"A price war is inevitable," Mr. Lowell said.

Fidelity "can get in there and undercut on price where they simply couldn't in the last decade. This is a market share moment," Mr. Lowell said.

Vanguard is "not nervous" about having the added competition from Fidelity, said spokesman David Hoffman.

The 10 comparable Vanguard sector ETFs make up 5% of the $300 billion in the company's total U.S. ETF business, he said.

"We're never engaged in a price war," Mr. Hoffman said.

"We're a low-cost leader across the board," he said. "I think investors can expect to see that in the future.”

Kevin Quigg, the global head of ETF sales strategy for State Street, said that investors should focus their attention on total cost of ownership of the sector ETFs.

The company's sector SPDR ETFs were the second line of ETF products it brought to market, he said.

"We have through time lowered our expense ratios from a scale perspective as we have the ability to pass it on to our shareholders," Mr. Quigg said. "They are bringing products in the same space, and at the end of the day, investors decide."

Fidelity has every reason for wanting to dive into the ETF market.

Since 2008, Fidelity's active U.S. equity funds have suffered $87 billion in net outflows, according to data from Morningstar.

By contrast, the company's passively managed index funds have had positive net inflows of $15 billion since 2008.

The new Fidelity funds merit attention, said financial adviser Andrew Wang, senior vice president of Runnymede Capital Management.

"I'm certainly going to take a look at them," he said. "Expenses are definitely something that we want to be cognizant of."

OTHER ADVISERS WARY

Other advisers don't see low cost as a reason to get too excited about the new Fidelity lineup.

"It's not something that made me jump out of my seat," said Matt Reiner, chief investment officer at Capital Investment Advisors. "I don't know how exciting they'll b! e to stra! tegists."

Mr. Reiner's firm manages $1.3 billion in assets through a combination of ETFs and other investments, mainly using State Street's SPDR funds in the ETF arena.

David Blain, president of BlueSky Wealth Advisors, agrees that prices alone might not be enough to give Fidelity leverage in the market.

"For us, ETFs form the core of the portfolio, and it's just not something that gets switched out very often," he said. "To me, it's a marketing gimmick."

Although there are critics, Mr. Rawson said that Fidelity's strong brand name, established brokerage platform and numerous managers are key factors working in the firm's favor with the launch of the new ETFs.

The company isn't taking the new venture lightly and is investing heavily to make up for lost ground, he said.

"I think they view this as a very serious strategy," Mr. Rawson said.

"They have very competitive index products," he said. "It would only make sense for them to have ETFs to go along with that."

Mr. Lowell, who is also the chief investment officer at Adviser Investments, said that he will be looking into the products at his firm, which has close to $3 billion in assets under management.

"We'd be foolish not to," he said.

Citing regulatory restrictions ahead of the launch, Fidelity spokeswoman Erica Birke declined to comment.

What debt deadline? Stocks soaring

NEW YORK — With the government shutdown now in its 16th day and Congress still at odds over how to end the debt impasse, U.S. stocks opened sharply higher, a sign that Wall Street still remains convinced Washington will avert a debt default.

With a debt limit deadline less than 14 hours away, the Dow Jones industrial average was up more than 180 points, or 1.2%, in early trading. The S&P 500 was up 1.1% and the Nasdaq composite was 1% higher and trading at a fresh 13-year high.

Investors are betting a deal gets done.

WARNING: Fitch issues warning on U.S. credit rating

The reason: the fallout of a U.S. default would be so unpredictable and potentially damaging to the financial system that few people on Wall Street think Congress would let such a self-inflicted wound occur.

"We have to assume that it is in no one's interest for the government to default," says Rob McIver, co-portfolio manager at Jensen Quality Growth Fund.

The short-end of the U.S. bond market, however, continues, to shows signs of distress. The yield on the Treasury bill that comes due on Oct. 31, dubbed "The Halloween Bill," has seen its yield jump to 0.60% in trading today, despite trading in a normal range of 0.05% to 0.10% for most of the year before moving higher and higher this month, according to a Bloomberg chart supplied by UBS.

ADVANCE AUTO PARTS: Gets General Parts for $2B

MATTEL: Monster High, Barbie boost results

This type of short-term bond is typically referred to as a risk-free asset, but investors are selling these bills because they are the most likely government security to be hit by a U.S. default, according to Boris Rjavinski, an interest rate strategist at UBS.

Global markets are in waiting and watching mode.

In overseas trading, the Nikkei 225 Stock Index closed up 0.18% to 14,467.14, however Hong Kong's Hang Seng fell 0.46% to 23,228.33.

Similarly, key European stock indexes were trending lower, with Britain's FTSE 100 index down slight! ly 0.40% to 6,522.37. Germany's DAX 30 index was down 0.10% to 8749.72, while France's CAC 40 index was down 0.70% to 4,224.39.

Still, in the U.S., investors are nervous. And financial markets are in limbo as they wait to see if Congressional Democrats and Republicans can strike a budget deal in time to avoid a debt crisis that could cause the U.S. to default on its debts for the first time.

The clock is ticking closer to the key Oct. 17 deadline -- that's tomorrow -- that will either return sanity to Wall Street or cause potential chaos. When the deadline comes the U.S. won't be able to borrow any more unless lawmakers act to extend the debt ceiling. Barring an agreement, the U.S. won't be able to pay all its bills.

The biggest risk is if sometime after Oct. 17, the U.S. misses interest or principal payments on government debt it has already issued. Such a default could undermine the world's confidence in a financial asset that's long been viewed as the safest investment on Earth.

Due to political brinkmanship, after last night's market close Fitch Ratings cited the potential hit to confidence due to a potential default as a reason it placed the USA's AAA rating on "rating watch negative."

Standard & Poor's, of course, downgraded U.S.debt to AA+ in the summer of 2011 after the last debt-ceiling fight. And John Chambers, chairman of S&P's sovereign debt committee told "CBS This Morning" today that if the U.S. does not pay its bondholders on time and defaults, the reaction in financial markets would "probably be an event that would be much worse than (the bankruptcy) of Lehman Brothers" back in the fall of 2008.

Still a Q&A research note put out yesterday by credit rating agency Moody's Investors Services that downplayed the odds of a credit rating downgrade for the U.S. has provided a sense of balance to the ratings downgrade debate.

Memories of the bad market reaction to the last debt-ceiling fight in Congress back in 2011 has some investors worrie! d. As the! talks dragged on in July of 2011 before ending in a last-minute deal to avoid default, the Dow suffered an eight-day losing streak in late July and early August. The blue-chip gauge then plunged 635 points, or 5.6%, on Aug. 8, 2011, the first day of trading after the S&P credit downgrade.

"The problem with the U.S. not paying investors on time is that it can destroy the very special status of Treasuries as a super-safe, liquid investment," says Rjavinski. "Treasuries are like an invisible glue that binds all of the world's financial markets. We can have a pretty bad chain reaction if there's a default."

The stock market has navigated Washington gridlock nicely so far. Despite a 133-point drop for the Dow Jones industrials on Tuesday after Congress failed to sign a deal, the Dow was still up 0.25% during the 15-day government shutdown. If the deadline passes without a deal, however, stocks would likely suffer a "strong negative reaction," says McIver. If a deal gets done, the market will refocus its attention on corporate earnings and economic growth, he adds.

But there have been more concrete signs of worry in the U.S. government bond market, especially one-month Treasury bills that will come due between Oct. 17 and early November, when the nation is expected to run short of cash.

Many banks and big investors have been selling these short-term instruments that could be hit by a potential default, says Bill Hornbarger, chief investment strategist at Moneta Group.

"Everyone is selling stuff that matures in October," he says.

A Treasury bill that matures on Oct. 24, seven days after the nation's ability to borrow ends, has seen its yield jump from roughly 0% in mid-September to more than 0.40% in recent days, according to a Bloomberg chart supplied by Rjavinski.

Similarly, a government auction of 3-month bills Tuesday also saw yields rise as high as 0.13%, vs. a high of 0.035% at last week's auction.

The issue isn't that investors don't think they wi! ll get pa! id back eventually, says Rjavinski; it is that they won't get paid on time.

"It's telling us investors are getting nervous," says Rjavinski.

Intel was down 0.99% to 23.18 in premarket trading despite topping Wall Street's estimates Tuesday by reporting a 49% increase in quarterly profit of $3 billion, or 58 cents a share.

Edgewater is an organizational consulting firm, offering technical, HR, and other advisory services. Revenues have been steady, but margins have improved sequentially in each of the last few years. Concurrent develops high-performance, real-time, multi-screen video solutions, providing "turn-key" solutions including software, hardware, and services. The end of an error
On April 24, 2001, a two-decade-long mistake was finally corrected when USX announced its plans to split two jointly held but separately traded businesses into their own fully independent companies: U.S. Steel (NYSE: X  ) and Marathon Oil. The steel and oil companies had operated together under the USX umbrella since 1986 after merging in 1982, although each had been traded independently since 1991.

Theodore Roosevelt's ascent to the presidency following President William McKinley's assassination revived the Sherman Antitrust Act from near-death, and it was finally used to dismantle a company in 1904. That year, the Northern Securities railroad trust -- controlled by J.P. Morgan and John D. Rockefeller, among others -- was found to control an unreasonably large part of American railroad traffic, and was broken back up into its component railroads. This reestablished the Act as a potent weapon against monopolies, and it was used many times over the following century against major companies, if not always successfully. Here are some of the landmark decisions issued under an interpretation of the Sherman Antitrust Act, with brief explanations provided below (you can also click on their links for more information):

    Standard Oil Co. of New Jersey v. United States, 1911. United States v. Alcoa (NYSE: AA  ) , 1945. United States v. AT&T (NYSE: T  ) , 1982. United States v. United States Steel (NYSE: X  ) , 1920. United States v. Microsoft (NASDAQ: MSFT  ) , 2001. United States v. American Tobacco, 1911.

The Standard Oil breakup in 1911 is the most important turning point of the Act's early history. It set a standard for "reasonableness" that has since been applied many times to determine what made a monopoly truly anticompetitive. Between this decision and the one that broke the American Tobacco trust several weeks later, the Supreme Court of 1911 is responsible for creating three long-tenured members of the Dow Jones Industrial Average (DJINDICES: ^DJI  ) -- two of which (both oil companies) are still on the index today.
